Using Freelance Artists |

If you are using a Freelance Artist on a particular job for a client do you have the freelancer sign a non compete or some form of documentation? Is there ever a concern that the Freelance Artist may contact the client directly to do additional work for the client after the original project is completed? Thanks for your answers.

We always have our Freelancers sign a Confidentiality Contract, even if they come from a temp agency; it's just part of the routine. It makes them aware of how we feel right up front and works well for us.

We use a confidentiality and employment status agreement with freelancers. It doesn't actually specifically contain a non-compete clause, although the prohibition against using any information obtained through us could somewhat have the same effect. We haven't particularly worried about that aspect, as it would be difficult for any individual to cover the same range of items as the firm does (we're a graphic design agency). I make it a habit to give them this to sign at the same time as the W-9.
